Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of Harbor ("we", "us", "our"), the hosting platform operated at host-harbor.com. By creating an account or using our services, you agree to these Terms. If you do not agree, do not use our services.

2. Services

Harbor provides:

• Application hosting: Deployment of web applications from GitHub repositories to EU-based infrastructure.
• Domain registration and management: Purchase and management of domain names via our registrar partners, including DNS management.
• Website builder: AI-assisted website creation and editing with deployment to hosting.
• Email hosting: Email services for domains (where offered).

Service availability and features may change. We will use reasonable efforts to notify you of material changes.

3. Account and Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information when registering.

4. Acceptable Use

You agree not to:

• Use the services for any illegal purpose or in violation of applicable laws.
• Host, distribute, or transmit content that infringes intellectual property, is defamatory, obscene, or promotes violence, discrimination, or illegal activity.
• Send unsolicited bulk email (spam) or use the services for phishing, malware distribution, or similar abuse.
• Attempt to gain unauthorized access to our systems, other accounts, or third-party systems.
• Overload or disrupt our infrastructure or interfere with other users' use of the services.
• Use the services in a manner that violates the terms of third-party services we integrate with (e.g., GitHub, domain registries).

We reserve the right to suspend or terminate accounts that violate these terms, and to remove or block content that we determine to be in violation. We may report illegal activity to authorities.

5. Payment and Billing

Fees for domains, hosting plans, and other services are displayed at the time of purchase. Prices include applicable VAT (e.g., Finnish VAT at 25.5% where applicable). Payment is due as specified (e.g., at checkout for one-time purchases, or on a recurring basis for subscriptions).

We use Stripe for payment processing. By providing payment information, you agree to Stripe's terms. Refunds are handled in accordance with our refund policy and applicable consumer protection laws. Monthly subscriptions may be cancelled at any time and are eligible for a partial refund for the unused portion of the current billing period. Yearly subscriptions may be cancelled within 14 days of payment and are otherwise binding.

6. Your Content and Data

You retain ownership of your content and data. You grant us a limited license to use, store, and process your content as necessary to provide the services (e.g., deploying from GitHub, storing in our infrastructure). Our use of your data is governed by our Privacy Policy.

7. Intellectual Property

We retain all rights to the Harbor platform, including software, design, and branding. You may not copy, modify, or reverse-engineer our platform except as permitted by law.

8. Service Level and Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice where feasible. We are not liable for downtime caused by third-party providers (e.g., registrars, hosting infrastructure) or circumstances beyond our control.

9. Termination

You may terminate your account at any time via Dashboard → Privacy & Data → Delete My Account. We may suspend or terminate your account for violations of these Terms, non-payment, or at our discretion with notice.

Upon termination, your right to use the services ceases. We will retain data as required by law (e.g., payment records) and anonymize or delete other data in accordance with our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, Harbor and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total liability for any claim arising from these Terms or the services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless Harbor and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the services, your content, or your violation of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of Finland. Any disputes shall be resolved in the courts of Finland. If you are a consumer in the EU, you may also have rights under the consumer protection laws of your country of residence.

13. Changes

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the services after changes constitutes acceptance. If you do not agree, you must stop using the services and may terminate your account.
